Terms of Use
Effective date:
These Terms of Use (“Terms”) govern your use of Gloss, a reading app provided by MounLab (“we”, “us”). By downloading or using Gloss, you agree to these Terms. If you do not agree, do not use Gloss. Our Privacy Policy explains how we handle information.
1. Relationship to Apple’s terms
Gloss is licensed to you through the App Store under Apple’s Licensed Application End User License Agreement (“Standard EULA”). These Terms are additional terms between you and MounLab. If they conflict with the Standard EULA, the Standard EULA prevails, except that the restrictions in section 6 always apply in addition to it and the limitation of liability in section 12 applies in place of the one in the Standard EULA.
These Terms are between you and MounLab, not Apple. Apple is not responsible for Gloss or its content, has no obligation to provide maintenance or support for it, and is not responsible for addressing any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
2. Eligibility
You must be at least 13 years old, or a higher age where local law requires, to use Gloss. If you are under the age of majority where you live, you may use Gloss only with the consent of a parent or guardian, who agrees to these Terms on your behalf.
3. The service
Gloss lets you read documents you import and offers features that run on your device, such as read-aloud, as well as features that use our online services, such as cloud translation. Online features need an internet connection and verification that you are using a genuine installation of Gloss.
We may add, change or remove features over time. We will not remove a feature you have paid for during a period you have already paid for without offering a reasonable alternative or remedy where the law requires it.
4. Your content
You keep all rights to the documents you import. Import and process only content you have the right to use. Gloss does not give you any rights in the works you read, and processing a work with Gloss, for example translating it or reading it aloud, does not entitle you to publish or distribute the result. You are responsible for making sure that your use of the work and of anything Gloss produces from it complies with the rights of others and applicable law.
When you use an online feature, you allow us and our service providers to process the content you send only to provide that feature, as described in our Privacy Policy. We do not claim ownership of your content or of the output Gloss produces for you.
5. Purchases, subscriptions and allowances
Purchases through Apple. All purchases are made through the App Store and processed by Apple. The price, billing period, and what each purchase includes are shown in the app and confirmed by Apple before you buy. Taxes and local prices are determined by Apple.
Subscriptions. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before it ends in your Apple account settings. Deleting the app or stopping use does not cancel a subscription. After you cancel, your subscription continues until the end of the period you have paid for.
Allowances. Some online features are measured against an allowance, which may come from a purchase, such as a subscription, or from a free allowance we offer. How much each allowance includes and when it expires are shown in the app. Some requests, such as those whose results can be reused, may use less of your allowance than the standard rate shown in the app, never more. Unless the app says otherwise, an allowance expires at the end of the period it belongs to and unused amounts do not carry over. Usage is deducted when a request is processed successfully, even if you leave before seeing the result; requests that fail are not deducted. Our service records determine your balance. Free allowances, and who is eligible for them, may change over time.
Restoring purchases. You can restore purchases in the app on devices signed in with the same Apple account. Restoring or reinstalling does not reset or add to allowances you have already used.
Refunds. Refunds are requested from and decided by Apple under its policies and your rights under applicable law. If a purchase is refunded, we remove the corresponding allowance; if part of it has already been used, we may deduct the difference from your other remaining allowances for the same feature, but never below zero.
6. AI model use restrictions
Some features of Gloss, such as read-aloud, use third-party AI models licensed under the BigScience Open RAIL-M License, which is included in the app. As a condition of using these features, the models or any derivative of them, you agree not to use them:
- (a) In any way that violates any applicable national, federal, state, local or international law or regulation;
- (b) For the purpose of exploiting, harming or attempting to exploit or harm minors in any way;
- (c) To generate or disseminate verifiably false information and/or content with the purpose of harming others;
- (d) To generate or disseminate personal identifiable information that can be used to harm an individual;
- (e) To generate or disseminate information and/or content (e.g. images, code, posts, articles), and place the information and/or content in any context (e.g. bot generating tweets) without expressly and intelligibly disclaiming that the information and/or content is machine generated;
- (f) To defame, disparage or otherwise harass others;
- (g) To impersonate or attempt to impersonate (e.g. deepfakes) others without their consent;
- (h) For fully automated decision making that adversely impacts an individual's legal rights or otherwise creates or modifies a binding, enforceable obligation;
- (i) For any use intended to or which has the effect of discriminating against or harming individuals or groups based on online or offline social behavior or known or predicted personal or personality characteristics;
- (j) To exploit any of the vulnerabilities of a specific group of persons based on their age, social, physical or mental characteristics, in order to materially distort the behavior of a person pertaining to that group in a manner that causes or is likely to cause that person or another person physical or psychological harm;
- (k) For any use intended to or which has the effect of discriminating against individuals or groups based on legally protected characteristics or categories;
- (l) To provide medical advice and medical results interpretation;
- (m) To generate or disseminate information for the purpose to be used for administration of justice, law enforcement, immigration or asylum processes, such as predicting an individual will commit fraud/crime commitment (e.g. by text profiling, drawing causal relationships between assertions made in documents, indiscriminate and arbitrarily-targeted use).
If you share output produced by these models, clearly state that it is machine generated. These restrictions are in addition to the full model licenses, which you can read in the app under open-source licenses.
7. Acceptable use
You agree not to: use Gloss in violation of law or the rights of others; interfere with, overload or attack our services; access our online services other than through the app; circumvent allowances, verification or other limits; or copy, resell or provide our online services to others. We may suspend or limit access to online features if we reasonably believe you are breaching these Terms or putting the service or other users at risk. Features that run only on your device are not affected.
8. Automatically generated output
Translations, read-aloud and other output produced automatically by Gloss may contain errors, omissions or mispronunciations. Check the original text before relying on them, and do not use them where accuracy is critical, such as for legal, medical or safety purposes.
9. Third-party components and services
Gloss includes open-source software and models, whose licenses are available in the app. Online features rely on third-party service providers. Your use of those components and of Apple’s services is also subject to their terms.
10. Availability
We work to keep online features available, but they may be interrupted by maintenance, network or provider problems, security measures or circumstances beyond our control. We do not guarantee that every request will succeed or be processed immediately.
11. Disclaimer
To the extent permitted by law, Gloss is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
12. Limitation of liability
To the extent permitted by law, MounLab is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or revenue, arising from your use of Gloss. Our total liability for all claims relating to Gloss is limited to the greater of the amounts you paid for Gloss and its in-app purchases in the 12 months before the claim and USD 50.
13. Your statutory rights
Nothing in these Terms limits rights or remedies you have under consumer protection or other laws that cannot be excluded or limited by agreement. Some of the exclusions and limits above may not apply to you where you live.
14. Changes to these Terms
We may update these Terms from time to time and will show the new effective date on this page. If a change materially affects your rights, we will notify you in an appropriate way before it takes effect. If you continue to use Gloss after a change takes effect, you accept the updated Terms. Changes do not reduce allowances you have already received.
15. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms. These Terms, together with the Standard EULA and our Privacy Policy, are the entire agreement between you and us about Gloss.
